Terms and Conditions for Pool Plans
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.
1. Intellectual Property Rights
The Service and its original content, features, functionality, and all materials available on the site, including but not limited to text, graphics, logos, and the digital pool plans ("Plans"), are and will remain the exclusive property of Pool Plans and its licensors. Our intellectual property is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Pool Plans.
2. License to Use Pool Plans
Upon purchase, Pool Plans grants you a limited, non-exclusive, non-transferable license to use one (1) copy of the purchased Plan for the sole purpose of constructing one (1) single swimming pool.
You are expressly prohibited from:
- Reselling, redistributing, or sub-licensing the Plans.
- Modifying the Plans to create derivative works for sale or distribution.
- Claiming ownership or authorship of the Plans.
2.1. Membership and Subscription Use Restrictions
Any subscription or membership plan purchased through the Service grants a license for use strictly limited to a single physical office location or business entity as registered at the time of purchase.
If a subscriber, builder, or user operates a business with multiple physical locations, branches, or distinct entities, each separate location or entity is required to purchase and maintain its own individual subscription or membership to access and utilize the Plans and other membership benefits. Use of a single subscription across multiple office locations is a breach of these Terms and will result in the immediate termination of the license without refund.
3. CRITICAL DISCLOSURES & ACKNOWLEDGEMENT OF RESPONSIBILITY
By purchasing and/or using our Plans, you acknowledge and agree to the following conditions, which are essential to the use of our products:
No Professional Engineering Services Rendered: Pool Plans is a design service only. We are not licensed architects or engineers. Our Plans are not stamped or sealed by a licensed professional. You MUST hire a local, licensed engineer to review, approve, and stamp these plans to ensure they are compliant with all applicable local, state, and federal building codes, regulations, and site-specific conditions.
Local Code & Permit Compliance: Building codes vary significantly by jurisdiction. You are solely responsible for ensuring that the Plans comply with all codes and regulations in the location where you intend to build. Our Plans are designed to meet general industry standards but are not guaranteed to meet your specific local requirements.
Builder & Contractor Responsibility: You and your chosen builder/contractor are responsible for the interpretation and proper execution of the Plans. It is the builder's responsibility to check all dimensions and details prior to and during construction and to ensure that construction methods and practices meet the highest industry standards.
Site-Specific Conditions: Our Plans do not account for your specific soil conditions, seismic activity, climate (frost lines, wind loads), or other environmental factors. A local engineer must analyze these factors and make any necessary structural adjustments to the Plans.
No Warranty: All Plans and information on the Service are provided "AS IS" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability or fitness for a particular purpose.
4. Purchases and Payments
If you wish to purchase any product made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase. We use third-party services for payment processing. All prices are subject to change without notice.
Refund Policy: Due to the instant, digital nature of our Products, all sales are final. No refunds, returns, or exchanges will be provided once a plan has been purchased and the download link has been made available. Please review all plan details carefully before completing your purchase.
5. Limitation of Liability
In no event shall Pool Plans, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any errors or omissions in the Plans; (iii) any costs related to labor, materials, or construction delays; (iv) any personal injury or property damage arising from the use of the Plans.
Our total liability to you for any cause of action arising out of or related to this agreement or the Plans shall be limited to the amount paid by you for the specific Plan in question.
6. Indemnification
You agree to defend, indemnify, and hold harmless Pool Plans and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) your use of the Plans and the subsequent construction process.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms and Conditions on this page and updating the "Last Updated" date.
9. Disclosure of Information to Trade Partners
By using the Service and/or purchasing our Plans, you acknowledge and agree that Pool Plans may share necessary and relevant information, which may include your company name, contact details, and the type of Plan purchased, with our trusted trade partners, affiliates, and suppliers (such as material vendors or specialized contractors). This disclosure is for the sole purpose of facilitating or supporting your construction project, providing relevant product information, and enhancing the overall service and support we and our partners provide related to the construction of your pool.
